1. General provisions

1.1. This Public Offer (the "Offer") is an official proposal by ИП «QG Consulting» (Баймагамбетова Эльмира), registration number KZ21UWQ02673326, registered by State Revenue Department for Medeu District, 124 Aimanov Street, office 507, Almaty, Republic of Kazakhstan (the "Provider"), addressed to an indefinite range of persons, to enter into a contract for the provision of information services through the Edline online education platform located on the Internet at myedline.com (the "Platform"), on the terms set out in this Offer.

1.2. This Offer is a public offer within the meaning of Article 395 of the Civil Code of the Republic of Kazakhstan.

1.3. Acceptance of this Offer consists in the User performing the following actions together: taking out a paid Premium subscription on the Platform and making payment in accordance with the terms of this Offer.

1.4. Acceptance of the Offer signifies the User's full and unconditional agreement to all the terms of this Offer. The contract is deemed concluded from the moment the funds are credited to the Provider's settlement account.

1.5. This Offer applies together with the User Agreement, the Privacy Policy, the Cookie Policy and the other documents published on the Platform. In the event of any conflict between this Offer and the User Agreement, the terms of this Offer prevail as regards paid services.

2. Terms and definitions

2.1. The Provider — ИП «QG Consulting» (Баймагамбетова Эльмира), 124 Aimanov Street, office 507, Almaty, Republic of Kazakhstan.

2.2. The User (Customer) — a natural person who has reached the age of 14, has accepted this Offer and has taken out a paid Premium subscription. A User aged between 14 and 18 must obtain the consent of a legal representative (parent, adoptive parent or custodian) to enter into this contract in accordance with Articles 22–23 of the Civil Code of the Republic of Kazakhstan.

2.3. The Platform — the Edline online education platform available at myedline.com.

2.4. Premium subscription — paid access to the Platform's extended functionality, provided on the basis of this Offer.

2.5. Basic access — free access to a limited part of the Platform's functionality, which does not require acceptance of this Offer.

2.6. Billing period — the period for which the Premium subscription is paid (one, four, six or twelve calendar months, according to the tariff plan selected).

2.7. Automatic renewal — the automatic extension of the Premium subscription at the end of a paid Billing period.

3. Subject matter of the Offer

3.1. The Provider undertakes to give the User access to the Platform's extended functionality under a Premium subscription, and the User undertakes to pay for that access on the terms set out in this Offer.

3.2. The services provided under a Premium subscription are informational and educational in nature and may include:

  • extended access to analytical data about universities;
  • extended tools for searching and comparing universities;
  • access to sample essays and educational materials;
  • extended functions of the Open Space section (notes, tasks, essays, calendar);

other functions available under a Premium subscription at the time it is taken out.

3.3. The specific list of functions available under a Premium subscription is set out on the Platform's page and may be changed by the Provider. The Provider undertakes to notify Users of material changes to the functionality.

3.4. The Provider does not guarantee the User's admission to any educational institution, the award of financial aid, scholarships, visas or any other outcome. The Platform's services are informational only.

  • the "Edline Intelligence" tools: essay review, profile assessment and production of the application report using artificial intelligence systems, within the limits set out in the AI Use Policy;
  • extended university profiles, tasks, documents, calendar and export of the university list.

The outputs of the "Edline Intelligence" tools are an automated informational assessment, may contain inaccuracies, do not constitute advice on admissions, and do not replace the decision of an admissions committee, a school counsellor or a mentor.

4. Price of the services and payment procedure

4.1. The price of the Premium subscription as at the date of publication of this Offer: the 1 (one) month tariff plan — 9,990 KZT; the 4 (four) month tariff plan — 29,990 KZT; the 6 (six) month tariff plan — 41,990 KZT; the 12 (twelve) month tariff plan — 79,990 KZT. The 4-, 6- and 12-month tariff plans are paid in a single payment for the whole period. All prices are stated in tenge and include applicable taxes.

4.2. Payment is made in tenge (KZT) through the Paylink internet acquiring system (paylink.kz). The Provider does not store Users' bank card data. All payment data is processed by the payment provider Paylink in accordance with its privacy policy and security standards.

4.3. The date of payment is the date the funds are credited to the Provider's settlement account.

4.4. Access to Premium subscription functionality is granted within 24 (twenty-four) hours of receipt of payment confirmation from the payment provider.

4.5. The Provider reserves the right to change the price of the Premium subscription. Where the price changes:

  • the new price applies only to new subscriptions and new billing periods;
  • Users with an active subscription keep the current price until the end of the paid Billing period;

the Provider notifies Users of a price change at least 14 calendar days before the start of the new Billing period, by sending a notice to the email address given on registration.

4.7. When a subscription is taken out, the User may be granted a trial period of 7 calendar days. The trial period is granted once per account. Where payment is made by linking a bank card, the first charge is made at the end of the trial period in the amount of the selected tariff plan, unless the User has cancelled the subscription before then. The date and amount of the first charge are communicated to the User before the card is linked, and again by email at least 14 calendar days before the charge.

4.8. Payment is made by one of the following methods at the User's choice: (a) by an invoice issued through the Kaspi service (by telephone number or by QR code) — with this method each payment is made by the User themselves for the relevant billing period, and no automatic charging applies; (b) by linking a bank card through the PayLink.kz payment service — with this method the subscription renews automatically. Payments are accepted and processed exclusively by those third parties. The Provider is not a payment organisation or payment agent, does not accept payments, and does not receive, process or store Users' payment data, including bank card numbers, expiry dates and CVV/CVC codes. The payment relationship arises between the User and the relevant payment service and is governed by its terms. The Provider is not liable for technical failures, delays or refusals in processing a payment on the part of payment services or issuing banks. This paragraph does not limit the Provider's obligation to supply the services paid for.

5. Automatic renewal of the subscription

5.1. The Premium subscription renews automatically at the end of each paid Billing period for a further period corresponding to the tariff plan selected, unless the User cancels the subscription before the date of the next charge.

5.2. The charge for the next Billing period is made automatically on the date corresponding to the date of the original subscription payment.

5.3. By taking out a Premium subscription, the User consents to automatic renewal and to funds being charged automatically to the bank card linked to the subscription, in the amount of the subscription price in force at the time of renewal.

5.4. The Provider sends the User a notice of the forthcoming automatic renewal and charge at least 3 (three) calendar days before the charge date, to the email address given on registration.

6. Cancelling the subscription

6.1. The User may cancel the Premium subscription at any time through the account settings on the Platform.

6.2. On cancellation of the subscription:

  • access to Premium subscription functionality continues until the end of the paid Billing period;
  • automatic renewal and further charges cease;

at the end of the paid period the User's account reverts to Basic access.

6.3. Cancelling the subscription is not in itself a ground for an automatic refund for the current paid Billing period.

7. Refunds

7.1. The User may request a refund of the amounts paid as follows:

  • (a) within 14 calendar days of the first charge under the subscription — a full refund;
  • (b) within 3 calendar days of each subsequent automatic charge — a full refund for the relevant billing period;
  • (c) after the periods stated in sub-paragraphs (a) and (b), on the 4-, 6- and 12-month tariff plans — a refund of the price of the unused whole months of the subscription.

7.2. The periods stated in paragraph 7.1 run from the date the User sends the request, not from the date the Provider considers it.

7.3. How a refund under sub-paragraph (c) is calculated. The discount given for a longer subscription period is not preserved on early termination. Months used are recalculated at the price of the monthly tariff plan — 9,990 KZT for each month begun. The amount refundable is the difference between the sum paid and the price of the months used. If that difference is zero or negative, no refund is made.

Example. A User paid for the 12-month tariff plan and requested a refund in the third month of the subscription. Three months count as used: 9,990 KZT × 3 = 29,970 ₸. The amount refundable is 79,990 ₸ − 29,970 ₸ = 50,020 ₸.

7.4. A refund request is sent to info@myedline.com. The Provider considers the request and sends the User a reasoned written response within 10 calendar days of receipt. Where the decision is positive, the funds are transferred within 14 working days. The time taken for the funds to be credited is determined by the issuing bank and is outside the Provider's control.

7.5. The User's right to withdraw from a contract for the provision of services for a fee, provided for by Article 686 of the Civil Code of the Republic of Kazakhstan, applies irrespective of the provisions of this section.

8. Contracting with minors

8.1. Registration on the Platform is permitted for persons who have reached the age of 14.

8.2. Users aged between 14 and 18 confirm on registration that they have the consent of a legal representative to create an account and use the Platform.

8.3. A User under the age of 18 may take out a paid subscription upon confirmation of the legal representative's consent to it being taken out and paid for (Article 159 paragraph 4 of the Civil Code of the Republic of Kazakhstan). Confirmation is given by ticking the relevant checkbox at the point the subscription is taken out; the fact, date, time, IP address and version identifier of the text are recorded by the Provider.

8.4. After the subscription is taken out, the User is offered the opportunity to provide the legal representative's email address for notices of forthcoming charges and receipts. Providing the address is voluntary.

8.5. Once the User reaches the age of 18, the consent of a legal representative is no longer required.

9. Mandatory disclosures before payment

9.1. Before payment for the Premium subscription is made, the User is provided with the following information:

  • the full price of the subscription for the selected Billing period;
  • information that the subscription renews automatically;
  • the date of the next charge;
  • how to cancel the subscription;
  • the refund terms;

the name and details of the Provider.

9.2. By making payment, the User confirms that they have read the above information and agree to the terms of this Offer.

9.3. Before payment is made, the following information is provided to the User on the subscription page: the name and price of the selected tariff plan; the length of the billing period; whether a trial period applies and its length; the date and amount of the first charge; how automatic renewal works and how to cancel it; the refund procedure; and the Provider's name, surname and given name, registration number, address and telephone number.

11. Limitation of liability

11.1. The Provider gives access to the Platform and its functionality "as is". The Provider is not liable for:

  • the accuracy, completeness or currency of information about universities published on the Platform;
  • universities' decisions to admit or reject an applicant;
  • the outcomes of using the Platform's information and tools;
  • temporary unavailability of the Platform for technical reasons;

the acts of third parties, including payment providers.

11.2. The Provider's aggregate liability under this Offer is limited to the amount actually paid by the User for the Premium subscription over the 12 (twelve) months preceding the event giving rise to liability.

11.3. The Provider is not liable for losses arising from events of force majeure.

12. Termination of the subscription

12.1. A Premium subscription terminates in the following cases:

  • cancellation by the User (with access retained until the end of the paid period);
  • an unsuccessful charge on automatic renewal;
  • blocking or deletion of the User's account;
  • withdrawal of the legal representative's consent (for minors);

cessation of the Platform's operation.

12.2. If the Platform ceases operating, the Provider undertakes to refund Users in proportion to the unused part of the subscription term.
