USER AGREEMENT

1.1. This User Agreement (the "Agreement") governs the terms of use of the Edline online education platform located on the Internet at myedline.com (the "Platform").

1.2. The Platform belongs to ИП «QG Consulting» (Баймагамбетова Эльмира), registration number KZ21UWQ02673326, 124 Aimanov Street, office 507, Almaty, Republic of Kazakhstan (the "Platform Owner" or "we").

1.3. By using the Platform, the User confirms that they have read this Agreement, the Privacy Policy and the Cookie Policy, and accepts their terms in full.

1.4. If the User does not agree with the terms of this Agreement, they must stop using the Platform.

1.5. This Agreement is a legally binding document and governs the relationship between the Platform Owner and the User.

The AI Use Policy forms an integral part of this Agreement.

2.1. User — a natural person who has reached the age of 14, has registered on the Platform and/or uses its functionality.

2.2. Account — the User's account on the Platform, created on registration and containing the User's personal data and settings.

2.3. Platform Content — all material published on the Platform by the Owner, including texts, analytical data, university descriptions, statistics, educational articles, design and software.

2.4. User Content — material created or uploaded by the User on the Platform, including notes, tasks, essays, university lists, calendar entries and other personal data.

2.5. Premium subscription — paid access to the Platform's extended functionality, on the terms set out in the Public Offer.

2.6. Basic access — free access to a limited part of the Platform's functionality.

2.7. Open Space — the User's personal workspace on the Platform for storing notes, tasks, essays, university lists and other material.

2.8. Collaborator — a person to whom the User has granted shared access to particular sections of their Open Space.

2.9. Edline Index — an analytical index developed by the Platform for the comparative analysis of universities on the basis of open data.

3.1. Edline is an online education platform providing informational and analytical tools to help students prepare for admission to universities abroad.

3.2. The Platform's functionality may include:

• a database of universities with analytical information and statistics;
• tools for searching, filtering and comparing universities;
• the Edline Index — a comparative analytical index of universities;
• the Open Space section for storing notes, tasks, essays and plans;
• automatic collection of essay requirements for saved universities;
• tracking of application deadlines;
• a shared access (collaboration) function;
• educational articles and guides;

examples of successful essays.

3.3. The Platform provides information solely for educational and informational purposes. The Platform is not an official representative of any university and is not affiliated with any.

3.4. The Platform does not guarantee admission to any university, the award of financial aid, scholarships, visas or employment. Admission decisions are taken solely by the universities concerned.

• the "Edline Intelligence" tools: essay review, profile assessment and production of the application report using artificial intelligence systems, within the limits set out in the AI Use Policy.

4.1. To use the Platform's full functionality the User must create an account. Registration is available:

• using an email address and password;

by signing in with Google (Google OAuth).

4.2. When registering through Google, the Platform receives the following data from Google: the email address. This data is processed in accordance with the Platform's Privacy Policy and Google's policy.

4.3. Registration on the Platform is available to persons who have reached the age of 14 (fourteen). On registration the User states their date of birth. Persons under the age of 14 may not use the Platform.

4.4. Users aged between 14 and 18 register on the Platform with the consent of a legal representative. On registration such a User confirms that the legal representative's consent exists by ticking the relevant checkbox. A User under the age of 18 may take out a paid subscription upon confirmation of the legal representative's consent to it being taken out and paid for (Article 159 paragraph 4 of the Civil Code of the Republic of Kazakhstan).

4.5. On registration the User undertakes to:

• provide accurate and current information;
• keep their information up to date;
• keep their account login details confidential;

notify the Platform Owner immediately of any unauthorised access to the account.

4.6. The User is responsible for all actions taken through their account.

4.7. Each User may create only one account. Creating several accounts by one person is prohibited.

5.1. The User may grant other persons (each a "Collaborator") access to particular sections of their Open Space through the shared access function.

5.2. When granting shared access the User themselves determines:

• the Collaborator's level of access: Viewer or Editor;

the sections to which access is granted: essays, universities, tasks, documents, calendar — all or particular sections, at the User's choice.

5.3. Limits of shared access:

• a Collaborator has no access to the User's profile or personal dashboard;
• a Collaborator with Editor access may propose changes, but all changes take effect only after the User confirms (approves) them;

the User receives notifications of proposed changes.

5.4. The User may change a Collaborator's level of access or revoke the access granted at any time.

5.5. By granting shared access, the User is themselves responsible for the confidentiality of the data the Collaborator obtains access to. The Platform Owner is not liable for Collaborators' actions or for their use of information obtained through shared access.

5.6. A Collaborator must use the access granted solely for the purposes for which it was granted, and may not distribute the information obtained without the User's consent.

6.1. The User may create and store their own material on the Platform in the Open Space section, including:

• notes and personal records;
• tasks and plans;
• essay texts;
• university lists;
• calendar entries;

other personal material.

6.2. The User retains all rights in User Content they create or place on the Platform. The Platform Owner acquires no ownership or intellectual property rights in User Content.

6.3. The Platform Owner does not use User Content for purposes unconnected with providing the Platform, and does not transfer it to third parties, except in the following cases: keeping the Platform operational (storage, display, synchronisation, backup); providing shared access at the User's initiative; processing by the "Edline Intelligence" tools at the User's request, in the course of which the essay text and the necessary profile information are transferred to the recipients named in the Privacy Policy, solely in order to produce the result; and complying with the requirements of the legislation of the Republic of Kazakhstan. The Platform Owner does not use User Content to train artificial intelligence models — neither its own nor those of third parties. The terms on which artificial intelligence systems are used are set out in the AI Use Policy.

6.4. The User bears full responsibility for the content of their User Content and warrants that the material they publish:

• does not infringe the rights of third parties, including copyright;
• does not contain unlawful, offensive, threatening or otherwise prohibited material;

does not breach the legislation of the Republic of Kazakhstan and/or of any other applicable jurisdiction.

6.5. If the User publishes content that infringes the rights of third parties or the law, the Platform Owner may:

• remove such content without prior notice;
• restrict or block the User's access to the Platform;

pass information to the competent authorities where required by law.

6.6. On receiving a well-founded complaint from a third party about copyright infringement, the Platform Owner considers the complaint and may remove the disputed content, notifying the User.

7.1. When using the Platform, Users are prohibited from:

• copying, reproducing or distributing Platform Content without the Platform Owner's written permission;
• using automated systems to collect data (scraping, crawling, parsing);
• extracting the university databases or other structured data of the Platform;
• using the Platform's information for commercial purposes without permission;
• interfering with the operation of the Platform, its software or its server infrastructure;
• attempting unauthorised access to the Platform's systems, to other Users' accounts, or to data not intended for the User;
• transferring, selling or otherwise making their account available to third parties;
• creating several accounts;
• publishing content containing malicious software;
• using the Platform to send unsolicited messages (spam);

using the Platform for purposes contrary to the legislation of the Republic of Kazakhstan or of any other applicable jurisdiction.

7.2. Breach of these rules may result in the User's account being restricted or blocked without prior notice.

• uploading to the "Documents" section copies of an identity document, passport or other document containing an individual identification number or biometric data;
• using the "Edline Intelligence" tools to obtain results in respect of third parties' data;
• circumventing the usage limits set for the "Edline Intelligence" tools.

8.1. The Edline Index is an analytical index developed by the Platform for the comparative analysis of universities from the perspective of international students.

8.2. The Edline Index is based on open data sources and the Platform's own analytical formula. The Platform does not own the universities' source data.

8.3. The Edline Index is intended solely for informational purposes and is not:

• an official ranking of universities;
• an academic assessment;
• financial advice;

a recommendation about admission.

8.4. Detailed information about the methodology, data sources and limitations of the Edline Index is set out in the document "Methodology and disclosures" on the Platform.

8-1.1. The "Edline Intelligence" tools operate using artificial intelligence systems. Every output is accompanied by a visible notice and machine-readable marking.

8-1.2. The outputs are informational in nature, may contain errors and inaccuracies, do not constitute advice on admissions, and do not replace the decision of an admissions committee.

8-1.3. The essay review tool does not create or rewrite essays for the User. The User remains the author of the essay.

8-1.4. The User may obtain an explanation of a result, require it to be reviewed by a human, and refuse to interact with artificial intelligence systems entirely. How these rights are exercised is set out in the AI Use Policy.

8-1.5. Use of the tools is limited as set out in the AI Use Policy. It is prohibited to use the tools to process texts and data not belonging to the User.

8-1.6. The AI Use Policy forms an integral part of this Agreement.

9.1. Some functions of the Platform are available only under a Premium subscription.

9.2. The terms on which a Premium subscription is taken out, paid for, renewed and cancelled are set out in the Public Offer published on the Platform.

9.3. The subscription is paid for through the Paylink internet acquiring system (paylink.kz). The Platform Owner does not store Users' bank card data.

9.4. The refund terms are set out in the Public Offer.

A Premium subscription is provided on the terms set out in the Public Offer and the Subscription and Refund Policy. When a subscription is taken out, the User may be granted a trial period of 7 calendar days. The terms of the trial period and the procedures for payment, automatic renewal and refunds are set out in the Public Offer.

10.1. All of the Platform's material, including its design, texts, analytical materials, educational content, software, graphic elements, logos and trade marks, are the intellectual property of the Platform Owner and are protected by the intellectual property legislation of the Republic of Kazakhstan.

10.2. Use of the Platform does not grant the User any rights in the Platform Owner's intellectual property, other than a limited right to personal non-commercial use of the Platform in accordance with its purpose.

10.3. Any copying, reproduction, distribution, adaptation or other use of Platform Content without the Platform Owner's written permission is prohibited.

10.4. All university names, trade marks and logos mentioned on the Platform are the property of the respective organisations. They are used on the Platform solely for informational purposes.

11.1. The Platform Owner may restrict access to, temporarily block or delete a User's account where:

• the terms of this Agreement are breached;
• the rights of third parties are infringed;
• the law is breached;
• the Platform's functionality is abused;

a threat is created to the security of the Platform or of other Users.

11.2. Where an account is blocked for breach of the Platform's rules, a refund of a paid subscription may not be made.

11.3. The User may delete their own account through the account settings on the Platform. On deletion of the account:

• all personal data and User Content are deleted in accordance with the Privacy Policy;
• any active Premium subscription ends;
• access to the Platform ceases;

the account can be restored within 30 days of deletion; after that period the data is deleted irrevocably, except for data whose retention is required by the legislation of the Republic of Kazakhstan.

11.4. Deletion of an account is not in itself a ground for an automatic refund of a paid subscription. To request a refund the User must apply in the manner set out in the Public Offer before deleting the account.

Deletion of an account does not affect data whose retention is required by the legislation of the Republic of Kazakhstan. Processing of such data is restricted and the data is not used for any other purpose.

12.1. The Platform provides information and tools solely for educational and informational purposes. The Platform Owner is not liable for:

• the accuracy, completeness or currency of information about universities;
• changes to universities' requirements, deadlines or admission terms;
• universities' decisions to admit or reject an applicant;
• the grant or refusal of financial aid, scholarships or visas;
• any consequences arising from use of the Platform's information;
• the actions of Collaborators and the consequences of granting shared access;

temporary unavailability of the Platform for technical reasons, for maintenance or as a result of events of force majeure.

12.2. Where information on the Platform differs from universities' official data, the universities' official sources take precedence.

12.3. The Platform Owner's aggregate liability to the User is limited to the amount paid by the User for the Premium subscription over the last 12 (twelve) months.

13.1. The Platform Owner reserves the right to:

• change, update or extend the Platform's functionality;
• suspend the Platform for maintenance;

discontinue the Platform or individual functions of it.

13.2. If the Platform is discontinued, Users are not charged further. Refunds for the unused part of a subscription period are made in the manner set out in the Public Offer.

14.1. This Agreement is governed by and construed in accordance with the legislation of the Republic of Kazakhstan.

14.2. The parties undertake to resolve all disputes arising in connection with this Agreement by negotiation. The claims procedure is mandatory. A claim is considered within 10 calendar days of receipt (Article 42-4 paragraph 2 of the Law on Consumer Rights Protection).

14.3. If agreement cannot be reached, the dispute is subject to determination by the court at the Platform Owner's location in accordance with the legislation of the Republic of Kazakhstan.

15.1. This Agreement is available in Russian, Kazakh and English.

15.2. In the event of any discrepancy between the language versions, the Russian version of this Agreement prevails.

16.1. The Platform Owner may unilaterally make changes to this Agreement.

16.2. An updated version of the Agreement takes effect from the moment it is published on the Platform, unless a different date is stated in the updated version.

16.3. The Platform Owner notifies Users of material changes to the Agreement by publishing a notice on the Platform and/or sending a notice to the email address given on registration.

16.4. Continued use of the Platform after an updated version of the Agreement is published signifies the User's agreement to the new terms.
